StayEasy – Terms of Service for Hosts

Welcome to StayEasy! These Terms of Service (“Terms”) govern your use of the StayEasy platform as a Host. By registering and listing your property, you agree to comply with these Terms, which are designed to safeguard both Hosts and Guests, and to ensure transparent, safe, and fair use of our services.

 

1. Eligibility

  • You must be at least 18 years old and legally capable of entering into binding contracts.
  • By becoming a Host, you confirm that you are the rightful owner of the property or have valid authorization to list it.

 

2. Property Listings

  • Hosts must provide accurate, complete, and truthful information about their property, including amenities, location, pricing, availability, and applicable rules.
  • StayEasy reserves the right to edit, verify, or remove any listing that is misleading or violates platform policies.

 

3. Compliance with Laws

  • Hosts are responsible for ensuring their property complies with all local laws, housing regulations, society by-laws, zoning rules, and taxation (including GST).
  • StayEasy will not be held liable for any penalties, claims, or disputes arising from non-compliance by the Host.

 

4. Bookings and Cancellations

  • Once a Guest confirms a booking, the Host is obligated to honor the stay unless exceptional circumstances are approved by StayEasy.
  • Hosts may set cancellation policies, but StayEasy reserves the right to override or adjust policies in case of disputes.

 

5. Payouts and Host Earnings

  • All confirmed bookings generate Host earnings that are reflected in the Host’s Virtual Wallet (see Section 7).
  • Hosts may request withdrawals of available funds at any time with a single-click withdrawal request.
  • StayEasy processes Host payouts weekly:
    •      Earnings accrued between Monday–Sunday are settled to the Host’s designated bank account by the following Tuesday or earlier.
  • Early withdrawals may also be processed at StayEasy’s discretion, subject to banking timelines.

 

6. Service Fees

  • StayEasy may charge service or commission fees on bookings, which will be deducted before payout.
  • Fee structures will be communicated in advance and are subject to periodic updates.

 

7. Virtual Wallet System (Representative Ledger)

  • Every Host and Guest is provided with a Virtual Wallet, which serves only as a representative ledger reflecting bookings, earnings, refunds, and withdrawals.
  • The Virtual Wallet is:
    •       Not a bank account, prepaid instrument, or payment service.
    •      Not interest-bearing.
    •      Not transferable outside the StayEasy platform.
  • All actual money settlements are executed through StayEasy via banking/payment channels. The Wallet merely tracks balances and transactions for user visibility.
  • This structure ensures clarity and safeguards StayEasy from any licensing obligations under payment regulations.

 

8. Refunds to Guests

  • Guest refunds (arising from cancellations or adjustments) are reflected in the Guest’s Virtual Wallet.
  • Guests may:
    •      Use the balance for future bookings, or
    •      Generate a withdrawal request to transfer the refund to their original payment method/bank account.
  • Refund processing typically occurs within 3–5 business days, subject to banking timelines.

 

9. Communication Rules

  • Hosts are strictly prohibited from sharing personal contact details (phone numbers, email addresses, or external payment links) through the StayEasy chat before a booking is confirmed.
  • Violation of this rule may result in:
    •       Suspension of the Host’s account, and/or
    •      Forfeiture of any balance in the Virtual Wallet.
  • All pre-booking communication must remain within the StayEasy platform for transparency and safety.

 

10. Taxes and Invoicing

  • Hosts are solely responsible for reporting and paying applicable taxes (such as GST, income tax, or local levies) on earnings.
  • StayEasy may facilitate GST/tax fields in the platform but is not responsible for incorrect entries or non-compliance by Hosts.

 

11. Liability and Indemnity

  • Hosts agree to indemnify and hold StayEasy harmless against any claims, damages, or losses arising from:
    •      Misrepresentation of property,
    •      Guest safety issues,
    •      Legal violations, or
    •      Third-party disputes.
  • StayEasy provides only a digital platform and is not the owner/operator of listed properties.

 

12. Termination or Suspension

  • StayEasy may suspend or terminate a Host account at its discretion for:
    •      Policy violations,
    •      Fraudulent activity,
    •     Repeated guest complaints, or
    •     Breach of communication rules.
  • Hosts remain liable for bookings already confirmed prior to suspension.

 

13. Governing Law

  • These Terms are governed by the laws of India.
  • Any disputes shall be subject to the jurisdiction of the courts of Kolkata
