Welcome to StayEasy! These Terms of Service (“Terms”) govern your use of the StayEasy platform as a Guest. By registering, booking, or using StayEasy services, you agree to abide by these Terms.
1. Eligibility
You must be at least 18 years old to create an account and book stays.
Guests under 18 may stay only if accompanied by a responsible adult.
2. Account Registration
Guests must provide accurate and verifiable details during registration.
Each account is personal; sharing or misusing accounts may lead to suspension.
3. Booking and Payments
All reservations must be completed through the StayEasy platform.
Full payment (including applicable taxes, fees, and security deposits, if any) must be made at the time of booking unless otherwise specified.
Bookings are only confirmed once StayEasy provides written/email/app confirmation.
4. Cancellations and Refunds
Cancellation policies are set by Hosts and displayed at the time of booking.
Refunds arising from cancellations, disputes, or adjustments will be:
Credited to the Guest’s Virtual Wallet (see Section 7), and
Usable for future bookings, or withdrawable to a linked bank/payment method upon request.
Refund processing may take 3–5 business days, depending on banking timelines.
5. Guest Responsibilities During Stay
Guests must respect the property, follow the Host’s house rules, and comply with local laws.
Damages, theft, or violations of house rules may lead to:
Deduction from security deposit or booking value,
Additional charges, or
Legal action.
Guests must not engage in illegal activities, subletting, or misuse of the property.
6. Communication Rules
Guests are prohibited from sharing personal contact details (phone numbers, emails, or external links) with Hosts before booking is confirmed.
All communication must remain within the StayEasy platform to ensure security and transparency.
Violation may result in suspension of the Guest account.
7. Virtual Wallet System (Representative Ledger)
Each Guest is assigned a Virtual Wallet, which serves only as a representative ledger reflecting bookings, payments, refunds, and withdrawals.
The Virtual Wallet is:
Not a bank account, prepaid card, or payment service.
Not interest-bearing.
Only for tracking transactions within StayEasy.
Actual payments are processed via banking/payment channels; the Wallet merely reflects balances.
8. Refunds & Withdrawals
Refunds issued to the Guest’s Wallet may be:
Used for future bookings, or
Withdrawn anytime via one-click request on the app/portal.
Withdrawals are processed within 3–5 business days subject to bank/payment gateway timelines.
9. Security Deposits
Certain bookings may require a security deposit (held virtually).
Deductions may be made for damages, unpaid dues, or rule violations.
Remaining balances (if any) will be refunded after the stay.
10. Prohibited Activities
Guests agree not to:
Circumvent StayEasy’s payment system (directly paying Hosts).
Create fraudulent bookings or chargebacks.
Misrepresent identity or misuse discounts/referrals.
Engage in harassment, offensive behavior, or unsafe activities at properties.
11. Liability & Indemnity
StayEasy is a digital platform and not the owner or operator of listed properties.
StayEasy does not guarantee the safety, condition, or legality of any property.
Guests agree to release and indemnify StayEasy from claims or damages arising from their stay, except in cases of proven negligence by StayEasy.
12. Dispute Resolution
StayEasy provides limited mediation between Hosts and Guests in case of disputes.
The decision of StayEasy’s support team will be final for platform-related matters (refunds, cancellations, or penalties).
13. Termination or Suspension
StayEasy may suspend or terminate Guest accounts for:
Fraudulent activity,
Repeated violations,
Attempting to bypass StayEasy’s booking/payment system, or
Sharing personal contact details before confirmation.
14. Governing Law
These Terms are governed by the laws of India.
Any disputes shall fall under the jurisdiction of the courts of Kolkata.
